USE ANDABUSE OF HIJÃB IN EDUCATIONAL INSTITUTIONS IN NIGERIA: AN INQUIRY WITHIN THE CONTEXT OF ISLAMIC JURISPRUDENCE AND CONSTITUTIONAL PROVISION

Ḥijāb is no longer uncommon as the outing attire worn by female Muslims in most parts of the world, including Nigeria. This Islamic dress code is promulgated by the sharīʽah for female Muslims to safeguard their chastity and modesty. This paper attempts to delve into conception of ḥijāb from its various nomenclatures, Islamic guide to the use of ḥijāb, religious freedom vis-à-vis ḥijāb conflicts in Nigerian schools as well as abuse of ḥijāb in both conventional and faith-based schools in Nigeria. The paper strictly adopts analytical and descriptive research methods. The study observes that, contrary to the constitutional and sharīʽah provisions, many Nigerian schools have failed to admit the religious freedom for female Muslims to don ḥijāb irrespective of their dispositional and professional callings. The paper recommends that Nigerians need to be enlightened on the implications of religious and emotional sentiments as well as advocates explicit legislation on the right to use ḥijāb by interested female Muslim students in order to mutually abhor prejudice and acrimony towards building the tower of harmony and an egalitarian society.
